Hosting

The bot is hosted externally by the hoster netcup GmbH, Emmy-Noether-Straße 10, 76131 Karlsruhe, Germany. This is the recipient of your personal data and works for us as a processor. Our hoster will only process your data to the extent that is necessary to fulfill its performance obligations and will follow our instructions in relation to this data. The external hosting is carried out for the purpose of fulfilling the contract with our potential and existing customers (Art. 6 Para. 1 lit. b DSGVO) and in the interest of a secure, fast and efficient provision of our online offer by a professional provider (Art. 6 Para. 1 lit. f GDPR).

User data

As an app operator, we store your Discord ID once you interact with the app. A Discord ID refers to a unique identifier assigned to each user on the Discord platform. This ID allows users to identify and interact with each other. It's a unique number that Discord uses to identify users. Since the Discord ID is not directly linked to an identifiable natural person, but is only used for identification on the platform, it can be argued that it is not personal data in the sense of data protection. However, in some cases, Discord ID can be used to identify an individual if additional information is available. In such cases, the Discord ID could be considered personal data.

Replicate

1. Scope of data processing

The image URL provided as parameter with the /upscale command is sent as an input prompt to the API interface of Replicate(Replicate Inc, San Francisco, United States of America, https://replicate.com) and processed by one of Replicate's AI models.

2. Purpose of data processing

Replicate collects the data on behalf of the person responsible. This is necessary for the operation of the bot and to provide the basic function of the bot, upscaling images.

3. Legal basis for processing

The legal basis for the processing of your data by Replicate is Art. 6 Para. 1 S. 1 lit. b GDPR.

4. Duration of storage

It's not known how long the provided image URL is stored, as well as the upscaled image.

5. Possibility of objection and removal

Replicate Inc., San Francisco, USA is responsible for the collection and processing of personal data from residents of the EEA and Switzerland. By adding the Discord App Upscale Bot, application ID 1185135006113333258 ("Upscale Bot"), to your or any other Discord server, you understand and agree that:

• If you use the /upscale command with an image URL, the image is processed by an AI-powered image upscaling service provided through Replicate, Inc. (2261 Market Street #4056, San Francisco, CA 94114, United States, replicate.com). The Upscale Bot transmits the image to Replicate’s servers, where it is processed using models hosted on Replicate’s infrastructure. The resulting upscaled image is then posted as a Discord message.
• Replicate hosts and executes the AI models on its own cloud infrastructure or through partner compute providers. The model contributors (developers who publish models on Replicate) define the model behavior but do not receive access to your uploaded images or data. Temporary processing files may be created during inference and deleted afterward in accordance with Replicate’s privacy policy.
• The Upscale Bot app does not store message content or images at any time. When using the app, only the following data is stored and/or updated:
  • Discord ID
  • Hash of Discord ID
  • Credits Balance of Discord ID
• You understand that making requests to the image upscaling APIs on behalf of the user incurs costs for the Bot operator (Niklas Mueller, Johann-Sebastian-Bach-Str. 23, 34134 Kassel, Germany, info@diszy.com). Once the free credits are depleted, the user is required to purchase credits to continue using the bot’s main functionality.
