This privacy notice explains how personal data is processed when you use Upscale Bot (the "App").

Backend hosting by Contabo

The App backend and its database are hosted by Contabo GmbH, Aschauer Straße 32a, 81549 Munich, Germany. Contabo processes data on our behalf under a data processing agreement pursuant to Art. 28 GDPR. Hosting is necessary to provide the requested service (Art. 6(1)(b) GDPR) and to operate it securely and reliably (Art. 6(1)(f) GDPR).

Data processed by us

When you use /upscale, you can upload an image through Discord or provide an image URL. For uploads, the App retrieves the image from the attachment URL supplied by Discord. The App processes the image URL, image bytes and dimensions, your Discord user ID, a hash derived from that ID, your credit balance, and technical request information required to provide and secure the service. Discord IDs and images may be personal data.

Purpose and legal basis

The data is processed to validate the request, upscale the submitted image, return the result through Discord, prevent abuse, and manage credits. Processing required for the command is based on Art. 6(1)(b) GDPR. Security, abuse prevention, and reliable operation are based on our legitimate interests under Art. 6(1)(f) GDPR.

Storage by us

The App does not write input or output images to persistent storage. Image bytes are held temporarily in working memory while the request is processed and are released afterwards. The Discord ID, its hash, and the associated credit data are stored while the service or the credit account remains active, unless earlier deletion is requested and no legal obligation requires continued storage.

Image processing by Modal Labs

The submitted image is transmitted to Modal Labs, Inc., a Delaware corporation in the United States, and processed on our behalf using the open-source Real-ESRGAN model. Modal acts as our processor under a Data Processing Addendum incorporated into our service agreement.

Data location and international transfers

Request routing is configured for Modal's eu-west region and computation is restricted to Modal's EEA-wide eu region. Modal is a US company and uses subprocessors. To the extent personal data is transferred to the United States or another country outside the EEA, the transfer is protected by the EU Standard Contractual Clauses incorporated into Modal's Data Processing Addendum pursuant to Art. 46 GDPR.

Storage by Modal

The App uses Modal's Server primitive. According to Modal's security documentation, Server request and response payloads are not stored and are proxied directly to the container. Application access logging is disabled and the App does not log image content. Modal may retain technical app, container, security, and account metadata in accordance with its documented retention periods.

Discord

The source image is supplied through Discord and the result is posted as a Discord attachment. Discord processes this data under its own terms and privacy policy. See https://discord.com/privacy.

Sensitive content

Do not intentionally submit images containing special-category personal data under Art. 9 GDPR, images of minors, authentication documents, payment information, medical records, or other highly sensitive or confidential information. If we learn that such content has been submitted, we will stop processing it and delete any data under our control where technically possible.
