Our hoster will only process your data to the extent that is necessary to fulfill its performance obligations and will follow our instructions in relation to this data.
The external hosting is carried out for the purpose of fulfilling the contract with our potential and existing customers (Art. 6 Para. 1 lit. b DSGVO) and in the interest of a secure, fast and efficient provision of our online offer by a professional provider (Art. 6 Para. 1 lit. f GDPR).
Processed data
Ⅰ. Own data processing
User data
As an app operator, we store your Discord ID once you interact with the app. A Discord ID refers to a unique identifier assigned to each user on the Discord platform. This ID allows users to identify and interact with each other. It's a unique number that Discord uses to identify users. Since the Discord ID is not directly linked to an identifiable natural person, but is only used for identification on the platform, it can be argued that it is not personal data in the sense of data protection. However, in some cases, Discord ID can be used to identify an individual if additional information is available. In such cases, the Discord ID could be considered personal data.
1. Scope of processing of the data
If you address the app by using slash commands (e.g. /file, /chat) or by mentioning the bot, the following is stored and/or updated:
- Discord ID
- Hash of Discord ID
- Credits Balance of Discord ID
2. Purpose of data processing
This is required to run the app and manage your credits system.
3. Legal basis for processing
The legal basis is Art. 6 Para. 1 f GDPR, the protection of the legitimate interests of the app operator.
4. Duration of storage
The data is stored for the entire duration of the app's operation. This data persists as long as the app is active. We store this information to enable the app to function properly for you and to provide you with access to your balances and functions.
5. Possibility of objection and removal
You can object to the collection of the data. If you wish, your Discord ID and the associated credits balance can be deleted.
Uploaded Files & Documents
FileChat allows you to upload documents to create a Knowledge Base for your server.
1. Scope of processing of the data
If you upload a file using /file upload, the following is processed:
- The file content (text, data, etc.)
- File metadata (name, type)
- Server (Guild) ID to strictly isolate files to your server
2. Purpose of data processing
This is required to provide the RAG (Retrieval-Augmented Generation) functionality, allowing the bot to answer questions based on your documents.
3. Legal basis for processing
The legal basis is Art. 6 Para. 1 b GDPR (Performance of Contract) - fulfilling the service you requested.
4. Duration of storage
Files are stored until you explicitly delete them via /file delete or /file deleteall.
5. Possibility of objection and removal
You have full control. Admins can delete any uploaded document instantly using the bot's delete commands.
ⅠⅠ. Data processing by third parties
Google (Gemini)
We use Google Gemini AI for processing queries and indexing files. The data processed by Google is not processed in connection with or in connection with your personal data, so that no personal reference is made. However, they are listed for the sake of completeness.
1. Scope of data processing
User queries, uploaded file content, and potential image uploads are sent to the API interface of Google (Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA) and processed by Google's Gemini models.
2. Purpose of data processing
Google collects the data on behalf of the person responsible. This is necessary for the operation of the app and to provide the basic function of the app (AI answers, document search).
3. Legal basis for processing
The legal basis for the processing of your data by Google is Art. 6 Para. 1 S. 1 lit. b GDPR.
4. Duration of storage
Google retains data for a limited period to provide the service. For details on retention, please refer to Google's privacy documentation.
5. Possibility of objection and removal
Google LLC is responsible for the collection and processing of data. For more information on how Google processes data, see Google's Privacy Policy at https://policies.google.com/privacy and their Generative AI terms.
Your rights
As the person concerned, you have the right to information, the right to correction or deletion, the right to restriction of processing and the right to object to the processing of your data. If you have given us your consent, you can revoke this at any time with effect for the future. Please address your objection informally to the above address. In addition, you have the right to data portability. You also have the right to complain to a supervisory authority about the processing.
